In today’s era of big data,contains the rich data,and it had become the focus of attention,which contains the huge value and infinite development potential.It is necessarily making this should have no smoke of the battlefield filled with gunpowder taste,behind the parties competing for affects not just the personal data security problems,but even also affect the social development and national security.Data and information security have attracted unprecedented attention in countries from the beginning of the world’s "prism gate" event.Data security is closely related to the lives of all of us.In the tide of digital,under the background of big data,because the public awareness of data protection is weak in China,it often becomes the beginning of data breaches,used by the upsurge to collect the data crisis occurred frequently.In the legal field of data protection,the definition of the civil law attribute of data has always existed in academic circles.Outstanding properties defined necessarily leads to protect the data of a larger problem,in order to better from the perspective of civil law to protect the data,especially the most closely connected with our personal data,in this paper,first,from the basic concept of clarifying related concept definition,the brief analysis and comparison of several mainstream about data attribute theory,thus leads to our country in the field of civil law for protection of personal data of the existence of a few questions.Among them the author based on two of the most typical abroad comparative analysis of the data protection mode,hope to be able to get a personal data protection be used for reference to China’s experience.In the last part of the article,the author through the above elaboration,boldly on the data of the civil law protection of some ideas and suggestions are putting forward.
