our country has become the world’s "two and a half the Internet market" is an important part of,along with our country the development of information technology and Internet technology mature,"Internet +" the coming of the era,all walks of life deep integration with the Internet,information technology in brings to the society and convenient service,at the same time,also brought an opportunity to illegal criminals.Personal information is constantly leaked,and all kinds of criminal ACTS of illegal purchase and use of personal information have been exposed,which has caused a bad influence on the victim,and seriously endanger the person and property.Foreign countries are learning from China’s Internet.However,in the criminal protection of personal information,China still lags behind.Although our country through the "criminal law amendment(7)","criminal law amendment(9)to the personal information are made certain supplement and correction,at the same time,the supreme people’s court,the supreme people’s procuratorate on handle criminal cases of infringement of personal information to explain some issues of applicable law are implemented,this had to show our country to pay a high degree of attention network information security.However,at present our country criminal law protection of personal information has many shortcomings,this paper make a detailed inquiry,hope is beneficial to the criminal law of personal information protection in China to make theoretical research.In this paper,based on the research results of the relevant problems,this paper is divided into five parts based on the research results of the relevant problems in China’s criminal law,which lags behind the practice of information society.The first part,the analysis summary of personal information under the background of information society,the concept of the information society,personal information,summarize and analyze the legal characteristics of personal information and the paper expounds the necessity of the protected;The second part,detailed exploring the evolution of criminal law on personal information protection in China the status quo,from the criminal law amendment(7)before and after,"criminal law amendment(9)"and "the supreme people’s court,the supreme people’s procuratorate on handle criminal cases of infringement of personal information to explain some issues of applicable law to protect personal information of the criminal law in China to explore;The third part,under the background ofinformation society problems in Chinese criminal law to protect personal information,respectively from the criminal law protection system on existing crimes and infringement of personal information,a detailed analysis;The fourth part,from the Anglo-American legal system and the continental law system to learn from the relevant laws and regulations;The fifth part,aiming at the existing problem of step 4 points,draw lessons from foreign experience,respectively from the macro and micro Suggestions to perfect our personal information protection of the criminal law,hope to solution of relevant legislation and has considerable benefits.
