With the development of social economy and science and technology progress,Internet technology is becoming more and more popular in China.There is a growing demand for spiritual and cultural life.Video games as a new form of entertainment appeal to global players.As an important part of the Internet economy,the video game industry is increasingly showing the tremendous development potential and impetus.In recent years,the game industry in China has been developed by leaps and bounds.The game market represented by Fantasy Westward Journey,King of Glory,League of Legends and other electronic games has attracted the attention and welcome of the capital market.As a new industry,the industry scale of China's video game industry is expanding rapidly,which is followed by unhealthy competition between game companies,which leads to more and more disputes about the infringement of video game copyright.Especially in the field of game copyright,that is,copyright protection,China has increasingly highlighted the lagging behind of legislation and justice in recent years,which can not effectively adapt to the rapid development of China game industry.Therefore,it is urgent to study the copyright protection of video games.Based on the research on the above problems,this paper aims to provide some useful ideas for the healthy development of China's video game industry.This article is discussed through a simple introduction,mainly including five parts.The first part briefly introduces the basic theory of the video game,including its meaning,characteristics and types.Through the above introduction,we have a preliminary understanding of the whole of the video game.Video games are interactive games that can be controlled by players and run on specific electronic devices by pre-programmed coded command sequence programs.With the vigorous development of the video game industry,the copyright protection of video games is worth our in-depth exploration.Therefore,it is of great significance to protect the copyright of electronic games.Finally,the paper focuses on the legal attributes of video games.Through the analysis of legal theory,the game conforms to the characteristics of "works" in the copyright law,so the game can be the object of copyright law protection.However,it is still open to discuss what type of work is protected by electronic games.By discussing the types of games that video games can belong to at present,games as software programs will ignore the most aesthetic expression of games.Games as audiovisual work will make their interactivity neglected.The protection of various elements will also reduce the scope of protection.Therefore,I believe that when the time is ripe,we can classify video games as an independent type of work as a protection object of copyright law,and simply discuss the feasibility of classifying it as an independent type of work into copyright law.The second part mainly discusses the status quo of China's video game copyright protection and some existing problems.First of all,it analyzes the status quo of China's game copyright protection.From the analysis we can see that our current protection of game copyrights is still lacking.Then,from the perspective of theory and practice,we sort out the shortcomings of our game copyright protection.The third part focuses on the overseas electronic game copyright protection status and related infringement determination methods.This section will be illustrated through the classic cases abroad.On the basis of the above analysis,we summarize the enlightenment of foreign tort judgment methods to China,and extract the essence,so as to draw a practical decision method according to the current judicial situation in China.As the saying goes,“The stones of other hills can attack jade”.By introducing the protection of foreign game copyrights,China can get some enlightenment from it.The fourth part mainly discusses some suggestions on how to improve the copyright protection of video games in China.On the basis of the previous article,we put forward some suggestions on the basis of the practice.The last part is the epilogue,which tells the leitmotiv of this article.
