Abstract/Summary:
Farmers’ housing is one of the most important property rights owned by farmers.Their value and protection of property rights have received more and more attention,among which is the issue of the mortgage setting of farmers’ housing property rights.However,there is a considerable lack of laws in this area.Comparing with the perfect housing mortgage system in cities,it is urgent to improve the shortage of farmers’ housing property rights mortgages,to fill this legal gap,and to make the legal system of farmers’ housing property rights mortgage more feasible.In this social context,this article uses literature analysis,comparative analysis,practice analysis to conduct an in-depth analysis of farmers’ housing mortgage right.The first chapter introduces the purpose and value of the research,the domestic and foreign research review,and the main contents and methods of the research.The second chapter provides the theoretical basis of this article by combing the historical process and characteristics of institutional development of farmer’s housing property right.The third chapter analyzes the basic problems in the mortgage policy of the farmers’ housing property rights,that is,the feasibility and necessity of the implementation of the policy.It proves the theoretical basis and practical basis of the mortgage policy of the farmers’ housing property rights.The fourth chapter,through the inspection of the status quo of mortgage practice in Chongqing Jiangjin,Fujian Shishi,Xuancheng,Anhui,Mayang,Hunan,and Wujin,Jiangsu,finds out innovations and deficiencies in the pilot area and concludes the dilemmas the mortgage of the farmers’ housing property rights is facing.And focus on the explanation of the reasons for the predicament of the farmers’ housing property rights mortgage from the legal system,the evaluation mechanism,the mortgage market,the risk mitigation mechanism,and the social security system.The fifth chapter,from the experience of foreign peasant house mortgages,the principle and the specific proposals of farmers’ housing property rights mortgage,provides alternative institutional models for the reconstruction of farmers’ housing property right mortgagesystem.At last,make a simple summary of the research on the mortgage system of farmers’ housing property rights.
