Economy of layoffs is when the enterprise will face major production and management difficulties,bankruptcy reorganization or the objective circumstance have significant change of circumstances.It use to save labor costs to alleviate the pressure of owe business and get rid of the current difficult.It is a special form of unilaterally terminate the labor contract between the enterprise and the laborers.At the moment,economic globalization intensified and the market competition is also increasing fiercely.Lots of businesses usually take the means of cuts surplus resources to keep its even better survive in this particular period.Therefore,it is necessary to balance the operation of enterprises and the employment guarantee of laborers.The article introduces the basic theory of economic cuts to in-depth analysis and research.First of all,expounds the connotation of economic layoffs.After a preliminary understanding of the economic layoff system,the basic content of China’s economic layoff system was systematically discussed.through the analysis and research,puts forward the existing problems of the legal system.That is,the economical redundancy system in our country,the existence of legal conditions,the existence of void,the unreasonable compensation,the lack of right to employ the right to employment legislation.Then,comparing and analyzing the layoff systems of some representative countries abroad,introduces the relevant systems of the collective dismissals in Germany,Japan’s “organize fire system”,fire system in Taiwan area in our country,and analyzes the advantages of terms,to give enlightenment on economic jobs legislation of our country.At last,made some suggestions for its improvement.For example,clarify the application conditions for economic layoffs,improve the concept of employer-employee negotiation,clarify the authority of labor administrative departments to perform their functions,specify the provisions for the degree of economic compensation,and promote the fair and rationalization of priority retention and so on.
