The economic layoffs refers to that the employer terminates the employment contracts with acertain number of employees to improve their production and business operation status, in the case ofbankruptcy restructuring or serious difficulties in production and business operation. Economic layoffssystem involves both the employer's operational autonomy and the employment security right ofemployees, and how to balance the two aspects are very important in practice.This paper attempts toanalyze economic layoffs system on the basis of existing legislation, points out the problems andprovide feasible proposals by learning from the economic layoffs system of other countries and regions.Part I: This part defines the concept of economic layoffs to make cleat the scope of this paper, andthen introduces the legislative overview of China's economic layoffs system.Part II:This part introduces and analyzes the economic layoffs system of United States, France,Germany and Taiwan.Part III: This part points out the problems that exist in the current economic layoffs system byreferring to relevant provisions of other countries and regions. China's economic layoffs system needs tobe improved in the aspects of the condition and the procedure of economic layoffs and the priority toemploy mechanism. For instance that is not clearly defined the economic layoffs system should be thelast resort to improve the operation status of employers,the right of employee to know the layoffs inadvance has been ignored and the restraint mechanism of the priority to employ is unreasonable.Part IV: This part gives reasonable suggestions to improve China's economic layoffs system basedon comparison of current economic layoffs system between China and other countries andregions.Accordingly this paper also discusses how to improve the condition and the procedure ofeconomic layoffs and the priority to employ mechanism.For instance we can make it through settingjobs' maintenance plan or specifying the right to know of the laid-off employees or establishingincentive mechanism for the behavior of employer who has established the priority to employmechanism.
