Research On The PPP Project Contract Standardization In China

The PPP model,the acronym of Public-Private-Partnership,is also known as the "3p Project" in the relevant fields of our country.It refers to the cooperation between the government and private or non-official social organizations in order to complete the municipal infrastructure projects.Or,in order to provide certain public goods and public services,a partnership formed between them on the basis of the concession agreement,and through the formal signing of an agreement,a contract to clarify the rights,responsibilities,legal obligations of both parties.With a view to the successful completion of the cooperation project,the efficient "government-enterprise cooperation" model.The PPP model entered China from the western group in the early years of reform and opening up,and went through five stages of development.In the early stage of reform and opening up,the PPP project did not attract the attention of the Chinese government,only in Guangzhou.A random project experiment was carried out in Beijing.After the 14 th CPC National Congress put forward the concept of "socialist market economy",the PPP project gradually entered the pilot stage and achieved considerable results.Since then,with the continuous promotion of the pilot experience,the PPP model has gone through the development stage of the 20 th century,and the repeated stage has ushered in today's comprehensive promotion stage.Because our government adopted the PPP model compared with the developed countries in the West.At home,the initial government did not carry out effective "top-level design",which led to the lack of experience of our government in making policies and implementing systems on the PPP model,and also caused instability of the PPP project.The concrete manifestation is in the central government policy and the local policy uncoordinated aspect.Since the operation of PPP projects is based on national policies,only by taking national policies as the guidance,can the projects be more reliable.Capital caused a huge impact,more serious violation of the dignity of the law.Based on the PPP project contract and its standardization,this paper will discuss the core position of PPP project contract and its standardization in the whole PPP mode,in order to effectively solve the legal problems that may appear in the running process of PPP project.The author has chosen the contract standardization to carry on the research intentionally,based on the related literature and the material,hoped through carries on the detailed analysis to each component element in the PPP contract system,attempted to elaborate the PPP project contract standardization research,To promote the mutual benefit of government and private capital under the PPP model and to help the government to distribute part of the risks in a reasonable way.It is also helpful for the theoretical circle to have a more comprehensive and detailed understanding of the PPP project and to conduct a more in-depth theoretical study of the legal specification files related to the PPP model.
