Research Of The Legal System Of Subsidies For New Energy Automobile In China

The earth’s fossil energy resources are limited.The overuse of fossil fuels has made the environment increasingly serious.The fossil energy consumed by automobile occupies a large proportion and the exhaust from traditional energy automobile is one of the main causes of environmental pollution.These problems have a great influence on people’s life.At present,France,Germany,the Netherlands and other countries have issued a comprehensive ban on fuel automobile,they vigorously develop new energy automobile to protect their energy and environmental security.In recent years,China also attaches great importance to the development of new energy industry.During the "12th Five-Year" period,the relevant departments of the State Council issued a number of measures to stimulate the development of new energy automobile and fully encouraged the development of the new energy automobile industry.With the support of the state,China’s new energy automobile has developed rapidly.According to statistics,in 2010,the number of production and sale of new energy automobile in China was 7 thousand,and then increased year by year.By 2017,the number of new energy automobile has reached 770 thousand.In 7 years,the number of production and sales of new energy automobile in China increased by 110 times.The speed of development was shocking.But the rapid development of the industry has caused many problems,especially in the area of subsidies for new energy automobile.This paper mainly analyzes the new energy automobile subsidy fraud problems from legal perspective and explores the deficiency of China’s new energy automobile subsidy system.Meanwhile,it examines the new energy automobile subsidy system in the US,Japan,Europe and other countries,in order to solve the subsidy system problem of new energy automobile.At the same time,it provides a favorable environment for other emerging industries in China which also need subsidy.This paper is divided into four parts.The first part is the basic part.It mainly introduces the new energy automobile industry and the general theory of the subsidy system of the new energy automobile,including its meaning,nature and characteristics,and the significance of establishing the subsidy system.The second part is the real analysis part.From the legislative level,we explore the current situation of the subsidy system of new energy automobile in China,and the problems in the implementation of new energy automobile.The third part is the comparison part,we observe and study abroad new energy automobile subsidy system,learn from the subsidy system experience of new energy automobile in foreign countries.The fourth part is the countermeasure part,and puts forward the solutions and suggestions for the existing problems of the new energy automobile subsidy in our country.In a word,China’s current subsidy system is imperfect and lacks the support of the legal level.It is necessary to make full use of legal tools and mature legal systems to ensure the healthy development of new energy automobile.
