Policy And Law Research On Cross-border Issues In Southwestern Ethnic Areasy

China is a united multi-ethnic country with a long history and vast territory.The land border line has more than 22 thousand kilometers,and the surrounding countries are numerous.The ethnic groups in the neighboring countries are very complicated.Hu Qiwang,a professor at Minzu University of China,explains the cross border ethnic groups in this way:“Cross-border ethnic groups live in two or more than two countries for a long time,but they retain the same ethnic characteristics and have the same ethnic identity.Although they are long separated in different countries,different effects of main ethnic local or other ethnic groups,have different degrees of variation in all aspects of language,clothing,material culture and spiritual culture,but in the bottom of their traditional culture and the depths of daily life,they still have relationw with the original groups.”The cross-border ethnic issues is the combination of history and reality by phase,politics and economy,culture,religion and other areas related to the country’s particularity,the particularity of cross-border ethnic cross-border ethnic issues,many cross-border ethnic issues are related to the issue of territorial sovereignty.These problems pose a certain degree of threat to the social stability and development of the border areas in China,the territorial integrity and the independence of sovereignty as well as the national security.It is of great practical significance for China’s internal affairs and diplomacy to strengthen the research on the policy and legal governance of border control in cross-border ethnic areas.Southwest ethnic areas have close contacts with Pakistan,Laos,Burma,Vietnam,India and other countries,the geographical position is extremelyspecial,cross-border marriage,the problems existed in this area illegal immigration,cross-border crimes,are required to be resolved in policy and legal level.China’s research on cross-border ethnic issues is a little later than that of the West.However,through these years’ academic research,many outstanding achievements have been made in this area.Most of these achievements are theoretical issues in conceptual research,and seldom exist for the numerous cross-border ethnic groups in the world and the problems they cause.The researchers usually focus on ethnology and ethnic issues,but not the national problem into the category of jurisprudence to study;researchers focus on law have not noticed the ethnic problems,but little difference of cross-border ethnic problems and the general problem of open treatment,mostly to cross-border ethnic issues is studied and discussed in the general national problem.This paper tries to respond to the cross-border issues of Southwest ethnic areas in the perspective of policy and legal governance.In view of this,the author intends to analyze from five levels.Firstly,general introduction,explains the background,purpose and significance of the topic,research status,research methods,and theoretical analysis,the definition of the core concept interpretation,and introduces the basic situation of the borderland of Southwest China and exploration of cross border ethnic areas under the background of the new era of governance,and the problem of cross-border ethnic groups analysis.Secondly,according to a large number of cross-border marriage cases in southwestern cross-border ethnic areas,the causes are analyzed,and some policy and legal measures are put forward.Thirdly,analysis of the causes and effects of illegal immigrants in southwest cross border ethnic areas,its unique ethnic,geographical and historical conditions is the special causes of illegal immigrants in the region,and illegal immigrants in the area of China’s national security and border management have varying degrees of effect.Fourthly,the article analyzes the governance basis of cross-border population flow in the Southwest ethnic areas,and the existing problems and measures to govern.Fifthly,according to the relevant legal problems of Southwest ethnic areas,through the integrationof the views and experiences of production in the world,based on national conditions and characteristics of the Southwest ethnic areas in China to discuss the problem of cross-border frontier governance in China’s minority areas of policy and law the way of governance,and puts forward some solving measures.The complexity of border governance in cross-border ethnic areas determines that this is a comprehensive and cross disciplinary research.It should not only analyze and research problems from a multidisciplinary perspective,but also use multidisciplinary theories,research results and data.Based on the use of relevant disciplines of knowledge on the frontier governance problems of cross border ethnic areas of holistic,systematic,dialectical materialism and historical materialism,summed up the law of universal,something from the complicated phenomenon.The significance of the theoretical research is to solve the practical problems,and the research on the border control policy and the legal governance of the ethnic areas is no exception.Therefore,we must contact the current international and domestic practical problems and study it practically and earnestly,and we should develop effective and effective solutions to the problems.Only in this way,can we draw a reasonable conclusion.Through this writing,I hope to give some meaningful advises in the cross-border issues of Southwest ethnic areas in policy and legal,and promote the attentions in governance of the cross-border ethnic groups,and look forward to our Chinese government strengthening the management with more and more success.
