Study On The System Of Life Imprisonment In China

With the introduction of the Criminal Law Amendment(9),the life imprisonment system has been officially introduced into our criminal law,making this system legal in China;In judicial practice,it has been declared a life sentence in five cases.The occurrence of the system broke through the theoretical flaws.The introduction of this system has responded to the government’s policy of cracking down on corruption and bribery crimes.It has made up for the insufficiency of the punishment in the penal system of China’s criminal law,and has allowed seamless connection between life imprisonment and death penalty.However,the system itself has certain flaws,and the possible problems in the application process make scholars continue to argue about this.This article is divided into three parts: The first part is an overview of life imprisonment.It introduces the concept,characteristics,and classification of China’s life imprisonment system while introducing relevant contents of countries outside the country;The second part summarizes and analyzes the system through longitudinal thinking:The main problems at the legislative and judicial levels,especially the unreasonable scope of application,the issue of retroactivity and major meritorious service,are analyzed;Lastly,the author puts forward suggestions and ideas for improving the system in China,base on the reality of our country,combining the reality of our country and aiming at the existing problems.
