Research On The Mechanism Of Self Investigation In The Stage Of Review And Prosecution

The prosecution to procuratorial organ for supplementary investigation will play an increasingly important role in the future of criminal proceedings,is one of the important topics of criminal judicial practice,judicial reform is a landmark exploration.What is the significance of the supplementary investigation system,whether it is feasible to promote it,and how to use it better in judicial practice,it is worth studying and thinking deeply.This paper focuses on the discussion and Research on the background of the reform of litigation of “trial as the center”,and standardize the supplementary investigation mechanism to use in the judicial practice,and strive to establish a new investigation and litigation,strengthen the procedure for investigation of guidance and control ability,through judicial practice actively,promote reform with the development of the “trial as the center” lawsuit system.This thesis is divided into six parts.Introduction: discuss the research background,research significance,research methods and content,research technology roadmap,and review the progress of self supplementary investigation at home and abroad,summarize the innovation points of research.The first chapter: This paper expounds the supplementary investigation system at the stage of examination and prosecution,defines the concept of self supplementary investigation,and introduces the relevant legal characteristics and basic functions of self supplementary investigation.At the same time,from the theoretical significance of self supplementary investigation,the legal principle of self supplementary investigation is discussed.The second chapter: By analysis of the supplementary investigation status,including the existing legal defects and practical needs,then introduced the typical case of N city procuratorate,analysis of N city procuratorate to the overall situation of investigation,investigation and comprehensive analysis from the quantity,the types of cases,the causes and methods of investigation and the results of N City procuratorate self investigation cases.The third chapter: On the basis of empirical research,this paper summarizes the practical difficulties and causes of self investigation,and puts forward effective solutions.The fourth chapter: Through theoretical overview and detailed legal research,and based on extensive data collection and investigation research,combining theory and practice,puts forward the countermeasures and suggestions to the investigation,adjustment and optimization of the self supplementary investigation function.Conclusion: Summarize the research results and analyze the shortcomings,which will provide reference for future research.
