Big data era,and the transfer of personal information,the way such as using increasingly diversified and high-speeding,in the production of life bring great convenience to citizens at the same time,the infringement of personal information probability increased,the type of infringement displays diversified characteristics,has great harm to citizens' legitimate rights and interests.Civil law as protecting the legal rights and interests of citizens,law enforcement punishment of infringement and compensate for or relief the patentee's rights legal basis,in the era of big data also need to make modest improvement of personal information protection mechanism.In 2017,our country the civil law general principles,the big data applications under the personal information protection made some new rules,help to improve the personal information of the civil law protection of the era of large data,but with complete effectively protect personal information and punishing infringing act compared to the requirements such as the mechanism also some deficiencies,needs further improvement.In this paper combined with the reality in China,in the literature,case analysis,collection personal information of the civil law protection mechanism at home and abroad contrast,on the basis of exploring large data application problems related to the personal information of the civil law protection.The research briefly introduces the relevant content of the protection of big data and personal information,and highlights the particularity and importance of personal information protection under the application of big data.On this basis,combining with the current social reality in our country,arrange our big data applications under the personal information protection in civil law,the law of change in teasing out the legal system construction in the development of the personal information of the civil law protection system.In the affirmation of the civil law protection system under the premise of continuous development,combined with the typical case,put forward the current big data applications under the personal information of the civil law protection in China is still large room for improvement of the real problems,analysis of the need to pay attention to solve the key problems.Put forward under the current our country civil law legislation on large data,the content of the protection of the rights and interests of personal information is not detailed and comprehensive,and the lack of effective security system of form a complete set,especially the network real-name system absence,relief system is not sound,etc.,greatly hinder the function of the civil law protection of personal information rights.Developed countries to the big data,collected outside the civil law protection of personal information about the system and guarantee mechanism,and summarizes its experience worthy of learning,contact the situation in our country,puts forward the scattered legislation,under the principles of value balance,build a feasible strategy of personal information protection mechanism of the civil law in our country,hope to cooperate to use,promote large data makes the personal information to get a better protection of civil law.
