Study On The Monitoring System Of Ming Dynasty

China's ancient legal supervision system is an important part of the history of Chinese legal system.Over two thousand years of official rule in China has accumulated a profound culture of supervision and a rich content of supervision.For the state,it is the bureaucracy that drives the effective functioning of the state.It is an important force for governing,governing and governing.Therefore,the ancient feudal rulers in order to defend their class interests,they had to be very good officials,good officials must be inspectors,prosecutors must need the law.In this process,the monitoring of the legal system emerged.After its emergence,it developed with the development of ancient Chinese legal system.In turn,the development of the legal system of supervision has enhanced the distinctive color of the local legal culture of China,and demonstrated the value and significance of the Chinese legal system.The continuity,integrity and systematism of ancient Chinese surveillance law are rare in the history of world legal system.China monitors the integrity of the legal content,the breadth of the subject.This paper attempts to summarize the experience and lessons of the supervision system of feudal society in China,and to make a brief analysis of the supervision system in Ming dynasty.I think these experiences and lessons are of great significance to reform and perfect the supervision system in China.In the long history of the monitoring system,whether the characteristics of the monitoring system or the structure of the monitoring system,the Ming Dynasty's monitoring system is the most distinctive and perfect.With regard to the monitoring system,the Ming Dynasty established two central and local monitoring systems,which coordinated,monitored and restricted each other.Compared with the Yuan Dynasty,the supervision law of Ming Dynasty was more severe in law enforcement and more strict in organization.On the legislative aspect,the perfect supervision legislation laid the foundation for the establishment of the supervision system in Ming dynasty,and provided the premise and guarantee for the effective implementation of the supervision law.However,the current laws and regulations of our country are in short supply.In order to improve the existing supervision law in our country,we can learn from the supervision legislation in Ming Dynasty.In law enforcement,the supervision departments of the Ming dynasty were independent and restrained from each other,and their internal division of labor was clear,which laid a solid foundation for maintaining the long-term stability of the feudal society in the Ming dynasty.The same is true of today's society,where the integrity of government officials can not be guaranteed by law without a clearly divided and balanced system of oversight.Nowadays,our country is in the period of reform,the reform of supervision system has entered the "deep water".Reform of the monitoring system has become an unavoidable issue.If the supervisory system is not strict and reliable,the government system will not be clean and efficient,which is the voice of the people and the urgent needs of the society,and should be considered by the ruling people.We should take history as a lesson,in the process of learning and innovation out of their own characteristics.
