With the prosperity of the game industry,the game industry has become an important part of the cultural industry and has made tremendous contributions to the country’s economic development.Due to the popularity of the live broadcasting platform,the game live broadcasting industry has rapidly emerged and attracted a large number of advertisers and investors.But in the fight game in a live commercial interests,the attendant problems of copyright disputes is increasingly obvious.Due to the complexity of the game-playing industry,the copyright issue of game works is also controversial,and there is no clear provision in the copyright law of China for game-playing,and there is no uniform standard in practice.The issue of copyright in game-playing is also involved.The problem of the originality of the work,the originality of the standard of identification itself is more vague.Therefore,it is necessary to discuss whether the game live broadcasting belongs to the object of copyright protection and whether the behavior of broadcasting the game screen through live software is reasonable and legal.There is great necessity for researching game live broadcasting copyright issues.The game live broadcast is divided into large-scale game event live broadcasts and personal game live broadcasts.Then,according to the different types of games,their legal attributes and ownership rights are demonstrated,and the legal relationships generated during the game live broadcast are clarified.Protecting the interests of related rights subjects through copyright law to promote the development of the game industry and the live broadcast industry.This article mainly discusses five parts.The first part discusses the big game live matches with higher originality belongs to the,works protected by copyright.The originality of the personal game broadcast is not enough to constitute a work,but it can be attributed to a video product and protected by neighboring rights.In the second part,the main body of copyright of large-scale game events live broadcast is the live broadcast platform,and the main body of right of personal game live broadcast is the video producer;The third part,under normal circumstances,the game player does not have creative behavior in the game,but if the game designer gives the game player a high degree of freedom to express space,the game player is likely to have creative behavior.Then it discusses whether the game player can be protected by the copyright law as a performer.In the fourth part,the relationship between five game play and fair use,and the live broadcast of large-scale games is not a reasonable use of the game.Personal game live broadcasting is not a reasonable use of the game,unless the game player plays a new work in a game that can be freely expressed and meets the requirements for fair use.The fifth part focuses on the games live in the infringement,assignment of responsibilities,as well as the amount of compensation is controlled by the game live reveal all the details of the rights violations of copyright law.
