Copyright Objects And Rights Ownership Of Online Game Live Video

The development of online game industry has driven the expansion of online game live market.These industrial interests have also triggered many disputes over online games and live broadcasting of online games.However,the lag of current copyright law seems to be incapable of responding to online game copyright disputes,which has aroused wide discussion in the society.Among them,the controversy surrounding the copyrightability of the online game pictures,as well as the copyrightability of online game live pictures and the legal position of game streamers in the online game live broadcasting are still fermenting,and there is no conclusion.Taking competitive online game as an example,this paper starts from the online game related industries,and effectively deals with hot issues such as confusion of copyright objects in online game live broadcasting and vague legal position of game streamers,in order to better achieve the balance of interests among online game related subjects.And thus,this paper mainly includes the following three parts:The first chapter analyzes problems of copyright protection in online game live broadcasting.First,objects of copyright are chaotic.Based on this,this paper clearly distinguishes the online game live pictures from the online game pictures,and differentiates live video game pictures recorded by game streamers from the live video of e-sports events.Secondly,the legal position of game streamers as authors or performers is unclear.The second chapter discusses objects of copyright in the online game live broadcasting.Firstly,starting from the originality standard,the substantive element of the work,the paper analyzes the workability of online game pictures and types of works according to characteristics of game pictures,and then distinguishes live video game pictures recorded by game streamers and live video of e-sports events to explore the nature of live online games pictures.The third chapter defines the legal position of game streamers in the online game live broadcasting.In the live broadcasting of competitive online games,the interactive operation of game streamers is not a creative act;however,unlike general players,game streamers generate a large spread of interest in the live broadcasting of online games.So it is suggested to endow them with legal status as performers.As for the game commentary of game streamers,when the personality style of game streamers is displayed,it can be considered as oral works for independent protection.
