Research Of Marx’s Philosophy Of Law In The German Ideology

The German Ideology is a philosophical work written by Marx and Engels in 1845 to 1846.In this classic book,Marx and Engels systematically expounded the basic principles of historical materialism by criticizing the incompleteness of Feuerbach’s materialistic and the idealism of The Young Hegelians.lt is a sign of the maturity of Marx’s philosophy.It is also the symbol of the formation of Marx’s historical materialism philosophy of law.It contains rich thought of the law philosophy.Marx and Engels criticized Hegel’s idealist philosophy ideas.They point out that the essence of law is based on social material life,the change and development of social material life promote the historical movement of law.They point out that the value of law comes from human needs,and the value goal of law is to achieve free and comprehensive development of human beings.Based on the German Ideology,this paper analyzes and studies Marx’s materialist philosophy of law.The text is divided into three parts:The first part inspects the theoretical source and realistic basis of the formation of Marx’s philosophy of law,and points out that Kant’s rationalism,Hegel’s rationalism and Feuerbach’s humanism are the important theoretical sources of Marx’s philosophy of law.During work of "The Rhenish Newspaper",Marx encountered the conflict between Hegel’s philosophy of law and the real society.Thinking about the problem of forest theft,and the study of the relationship between the citizen’s life and the country and law are the important realistic basis for the formation of Marx’s philosophy of law.The second part analyzes Marx’s systematic exposition of philosophy of law in The German ideology.In this book,Marx expounded the ontological thought of law based on material life,and pointed out the social material life decision the material objectivity of law and class will of law.The maintenance of private interests by law is also determined by the material life of society.They pointed out that the value goal of philosophy of law is to satisfy people’s need for freedom,rights and all-round development.It is further pointed out that the production,development and even extinction of the law are determined by the change and development of the material life of human society.They found that the emergence of law originate from the development of human productivity,The movement of law is the result of social basic contradiction movement.With the establishment of Communist society,law will perish.The third part discusses the theoretical and practical significance of Marx’s philosophy of law.Marx’s philosophy of law opened up a new perspective on the study of the philosophy of law,clarified the relationship between state and law and ownership,laid an important theoretical foundation for the further improvement of materialism.Meanwhile,Marx’s theory of legal philosophy has important theoretical and practical guiding significance for promoting the construction of socialist democracy and rule of law in China.
