To protect employers' legal rights and interests is one of the statutory responsibilities of the trade unions.Nowadays,as the incompatibility between the protection system of employers' labor rights and the development of society gradually becomes more and more evident,the responsibility of the trade unions to assert rights for employers should not be limited to fulfilling their "obligation to protect" in order to realize the positive aspect of employers' labor rights,but should also cover trade unions' "obligation to respect" the negative aspect of labor rights,which is "not to be subjected to interventions".In the modern corporate governance,trade unions have great significance to the formation of a healthy and orderly labor relations.The report of the 19th CPC National Congress clearly proposed that "we should improve the consultation and coordination mechanism involving the participation of government,trade unions and enterprises,and establish a harmonious labor relationship".This article conducts empirical tests on multiple aspects of the present situation of how trade unions protect employers' labor rights based on China Employer-Employee Survey.This paper uses OLS to conduct multi-dimensional empirical tests on the effectiveness of trade union rights defense functions.The results show that trade unions help to promote the protection of employers' right to be employed,right to obtain renumeration for their labor and right to receive vocational training significantly.However,trade unions do not help much to promote the protection of the right to take rest and the right to enjoy social insurance.Therefore,relying on the theory of opportunity cost,this article concludes that the reason for this is because there is no clear boundaries between trade unions' obligations to protect the positive aspect of labor rights and the negatives aspect,which causes the dilemma of"unintentional rest" and "non-optimal investment" for employers.It is suggested that trade unions assertion of rights for employers should aim at realizing the positive aspect of labor rights,and should also respect the negative aspect of labor rights.In other words,trade unions should put emphasis on the "realization of labor rights",but at the same time should avoid "over-protection"?...
