Study On The Legal Regulation Of Public-sharing Bike Cash-pledge

Cash pledge is widely applied in traditional leasing activities.The public-sharing bike industry combines traditional leasing activities with the Internet to change the nature of the cash pledge.A more innovative mode of "one thing and multiple loans" has been generated,which makes the public begin to pay attention to the security of Cash pledge.This mode enables public-sharing bike companies to accumulate large amounts of funds in a short time.Since there is no relevant cash pledge system in our country’s legal system and there is also lack of corresponding supervision for the emerging public-sharing bike industry,it has produced many problems.Specifically,some public-sharing bike companies embezzled user’s cash pledge without authorization,and some even absconded with cash,making it hard to refund the money.The deposit problem in leasing relationship is usually solved by transaction habits.However,this practice is not conducive to the safety of shared bicycle users,or to establish a good credit rating for public-sharing bike industry.So it is necessary to make relevant laws and regulations on cash pledge of public-sharing bike.Through the analysis of the nature,rights and status of public-sharing bike cash pledge,it is found that there are some problems in the stage of charging cash pledge,such as the amount of the cash pledge is not reasonable,the cash pledge of the form clause is lack of standard,the ownership of the deposit is not clear,and so on.After the money charged,there is a risk of misappropriation of the deposit caused by opaque operation as well as the risk of delay or inability to pay the deposit due to the lack of necessary supervision,and even the possibility of sliding into criminal offence.In view of the above problems,the regulation measures are put forward.We should establish the qualification examination system of the clash pledge collector,clarify the scope of the collection,standardize the provisions of the form clause,put the money under a third party custody,establish the regulatory mechanism and the refund mechanism for the public-sharing bike cash pledge.While protecting the interests of users,do not harm the development of this new industry.
