Research On Legal Issues About Personal Insurance Of Railway Passenger

In recent years,China's railway construction has entered a peak,take the train to become people's important transportation way,bringing great production and life.However,railway traffic accident frequency and increase,the personal and property damage to the railway passenger,how to better dispersion or transfer risk become the important content of attention.The important mechanism of the socialization of insurance as a risk sharing,gradually entered people's field of vision,railway passenger insurance become important to spread the risk of railway traffic accidents caused by the option.At present,our country's railway passenger personal insurance in a transition period,the planned economy era of insurance pattern is being under the condition of market economy replaced commercial insurance pattern,between the old and new alternate,hard to avoid has a lot of problems need to be solved.In this paper,according to interdisciplinary research Angle of view,historical and comparative analysis,system analysis method were studied.This paper can be divided into five parts:the first part mainly analysis of railway passengers personal insurance basic concept and the types and the establishment of the railway passenger person insurance contract with the changes.The second part mainly from the risk society,fault liability applicable,the concept of the welfare state and the rise of law and economics to investigate the influence of the railway passenger insurance legal system,analyzed the theoretical basis of railway passenger insurance legal system.The third part is from the perspective of empirical,railway passenger insurance legal system in our country the status quo and problems were analyzed.The fourth part is from outside the experience of countries and regions,in perspective of comparative law in Anglo-American countries,the civil law countries and Taiwan railway passenger personal injury insurance legal system.The fifth part is from the construction of a multi-level railway passenger personal injury insurance legal system,as well as puts forward the definition of the liability of railway transportation,general liability insurance,liability insurance and umbrella liability insurance,such as the diversification of railway passenger personal injury liability insurance,improve the railway passenger accident injury insurance and establish and improve the national relief funds of railway transportation.
