Study On Legal Liabilities Concerning Compensation For Personal Injures To Railway Passengers In China

The theory of civil law and basic regulation of railway traffic have been employed to clarify the current systems and its problems on personal damage of railway passengers in the dissertation. Meanwhile a study on the application of law, the range of compensation, the liability limit and compulsory insurance system has been done.The first chapter expounds the basic concept of law in our country on personal damage of railway passengers, and analyses its inclusive law elements.The second chapter makes study on the nature of the compensation of personal damage of railway passengers, probes into the problems of legal obligations in principle and obligation combined, then defines the principal part and onus probandi part and so on.The third chapter discusses the compensation range and criterion to our personal damage of railway passengers based on the above studies. Meanwhile it analyses the traits of the liability limit in our system of personal damage of railway passengers. At last, it makes comparison among different country's legal systems on the personal damage of railway passengers.The fourth chapter studies on the compulsory insurance system in China and analyses its existing value, thus to enrich the relief methods on personal damage of railway passengers.The fifth puts forward the advices on how to perfect the current system.Combining of theory and practice, the dissertation manages to make problems specific and systematic by employing comparative methods. In short, the dissertation lays emphasis on the compensation range and relative problems.
