A Study On The Legislative Power Of The Cities With Districts

In 2018,the 13 National People’s Congress passed the Amendments to the Constitution of the People’s Republic of China,which clearly stipulates that the cities with districts may make local laws and regulations to the law,and at the same time solves the problem that the legislative power of the cities with districts granted by the Legislative Law of 2015 is unconstitutional.Giving legislative power of the cities with districts is the necessary request of social development.It is beneficial to realize the rational allocation of legislation power,promote the rule of law and promote local economic development.After three years of legislative practice,many problems are exposed in the process of legislation,such as the scope of legislation power is not clear,local protectionism,the decline of the quality of legislation.For these problems,from the local legislation power exercise,in this paper,explores suggestions on improvement legislation power.Clear the legislation power of the cities with districts by the National People’s Congress of the People’s Republic of China,insisting on People’s Congress leading legislation,strengthening the construction of the legislative team.In this paper,there are four parts to study the legislation power of the cities with districts.The first part is the introduction.In this part,the research background of this paper is first introduced,and then the current situation of domestic academic research on the legislative power of the cities with districts is listed.Finally,the research methods of this paper are introduced.The second part introduces the connotation of the legislation power of the city with districts.First,the concept of the legislation power of the cities with districts is expounded.Secondly,the significance of the legislation power of the city with districts is analyzed.Finally,the development course of the legislation power of the cities with districts is combed out,and some problems of the legislation power of the city with districts are introduced.The third part is the key part of this paper.Based on the practice of our country,it introduced the problems of the legislation power of the cities with districts.It mainly includes the jurisdictional scope of the legislation power of the cities with districts is not clear,the local protection is legalized,etc.The forth part mainly aimed at the problems existing in the legislation power of the cities with districts,gives corresponding suggestion,including defining legislation authority of the cities with districts,leading the legislation by the people’s Congress,improving legislative capacity and strengthening legislative supervision.
