As the popularity of higher education in China has more and more high,university students are not popular than before,year after year,the present situation of college students'employment situation is a cause for concern.As is known to all,employment is the foundation of human survival,citizen's equal employment right is a basic human rights.China,s"National Human Rights Action Plan(2009-2010?2012-2015)"in the first part the "economic,social,and cultural rights"in the first place make specific provisions to the right to work,which can be seen emphasis on the protection of citizens' equal employment right.In the perspective of protecting the human rights,this paper is aimed at the lack of the legal protection of Chinese college students' right to equal employment,to study legal protection of Chinese college students' right to equal employment.This paper starts with the connotation and basic nature of college students' right to equal employment,summarize the current situation of legal protection of Chinese college students' right to equal employment and the deficiency.At the same time,draw lessons from foreign advanced legislation on students' right to equal employment,put forward specific suggestions of improving our country's legal protection of students'right to equal employment:The first is the legislation of the college students' equal employment right in our country as soon as possible,establish the flexible employment legislation principle,make anti-employment discrimination law in our country;The second is to strengthen law enforcement efforts,mainly to strengthen enforcement of labor inspectorates,establish guarantee equal employment right specialized agencies.The third is to strengthen judicial relief,mainly to strengthen judicial supervision.The employers should strictly abide by the law.
