Women’s equal right to employment is the basic right to realize the equality of men and women, it is an important part of women’s human rights, also it is an important way to make the "dignity of human personality" of women come true. Everyone is equal before the law is one concept of the constitution of China, this equality is only a form, women’s equal right to employment has become only a form under constitution. But in China, due to the lack of constitutional review system, women’s equal right to employment can not get Judicial Remedies measures in practice, this makes women a group without protection of law, a group gets employment discrimination when they face the employment, become the vulnerable group.There are theory and practice researches of women’s equal right to employment in both foreign countries and China, after the comparison and analyses, this article will summarize the forms of women’s equal right to employment practiced in China, analyze the main reasons, then put forward the establishment of judicial review system, perfect the legislation protection in China, try to change the traditional thoughts of Chinese people, to realize the equal employment right of men and women.There are three parts in this article:Part one is an overview of women’s equal right to employment, it explains the concept mainly through the definition of the right to equality and the right to employment, and puts forward the main content of female equal right to employment and the basic principles.Part two analysis of the existing problems and reasons of China’s women’s equal right to employment protection, after the analysis of Chinese female employment discrimination phenomenon, get the reason of female employment discrimination in China.The third part will show the present situation of how foreign women’s equal right to employment get protected, which will tell the gap between China and foreign developed countries in the presence of women’s equal right to employment protection, also tell us a enlightenment about how to protect women’s equal right to employment in China.
