On Civil Law Protection Of Internet Privacy Right

With the rapid development of the current network technology,the network has gradually developed into one of the main media to communicate,but the network is a double-edged sword,it is convenience to people,at the same time it is also easy to cause personal privacy violations.In recent years,the number of online privacy cases has been improved,and the infringing means has become more and more technical and the consequences of infringement are becoming more and more complicated.Privacy is an important personality right,infringement of privacy will bring great mental pain to privacy,and our laws on the privacy of the provisions is relatively rare.Internet privacy is a type of privacy,so the study of the privacy of the network not only can help to improve the relevant provisions of privacy,but also in line with the needs of the network industry.This article is divided into three chapters on the network privacy right to discuss.The first chapter is the basic theory of network privacy,network privacy is the development of privacy in the network environment,China’s general privacy policy is still in its infancy,so it needs to conduct a comprehensive and specific analysis of the privacy of the network.The first chapter first analyzes the connotation of the network privacy right in the general way to the special way,and explores the connotation of the privacy right by retrospecting the origin and development of the general privacy right,in order to lay the foundation of clarifying the connotation and characteristics of the network privacy right more clearly;Secondly,the analysis of the content of online privacy,network privacy is divided into personal network information self-determination and personal network space,personal network information self-determination is personal information on their own network has the right to know,the right to decide,the right to security,and so on;Personal network space contains personal mailbox and personal blog;the second chapter is the network of privacy violations of the performance and legal regulation.Internet privacy infringement will not only cause damage,but also lead to the corresponding legal issues,especially the protection of the boundaries of the network privacy protection,if not correctly identified,it is bound to affect the exercise of the right to freedom of speech,which caused by legal issues.This paper argues that it is necessary to examine the legislation of online privacy right from the angle of comparative law and the provisions of civil law in China,which can provide reference for the civil legislation of network privacy in our country.The third chapter is the liability of copyright infringement.The author analyzes the particularity of the elements of the infringement of network privacy and studies the illegality of the network privacy infringement.It aims to guarantee that the legislation can balance the right of freedom of speech and the relationship between social and public interests.
