Research On The Protection Of Personal Information By Network Platform

As a bridge from the industrial society to the information society,the Internet has become one of the basic elements for human society to run.No matter fervent artificial intelligence advocates or vigilant persons,cannot ignore the life style change that big data,Internet technology brings to us.Digital technologies represented by "Internet +" are deeply integrated with various social and economic fields,and the industry has shown new vitality because of the Internet +.As the basic "fuel" of the information society,data brings huge economic benefits and convenience to human society,which we cannot abandon.On the other hand,the invasion of personal privacy by big data technology has already jeopardized the individual's daily life.How to balance the interests of privacy and the economic conflicts brought by data is one of the topics discussed in this paper,that is,the development of science and technology should be under the basic human constitutional rights,such as the right of personality and the freedom of privacy.In view of the recent barbaric development of Internet platform and the fact that China has traditionally paid little attention to the protection of privacy rights,it has become the norm for network platforms to carry out business activities by using their users' personal information.As the creators of personal data,they are not only unable to share the benefits generated by personal data,but also have no right to speak.Network platform,through the collection,processing,the use of computers,mobile phones,other electronic sub-products and matching APP services,intentionally or unintentionally collect and record our personal information,and then form a powerful personal data pool.Many previous fragments,pieces of information or non-sensitive information are integrated,shared by big data technology,as long as enough personal daily information is collected,these personal information,which can be disclosed in the traditional sense,are transferred from "data point" to "data surface" under the tandem of big data technology,forming a kind of privacy infringement in essence.Facing the network platform,our "data personality" is "lifelike" in the "data pool" of the network platform,and controlled by it.In real society,for example,precision marketing,harassing calls,fraudulent calls,invasion of privacy or personality rights,and even some people use them to engage in criminal activities.This paper points out that the traditional privacy protection framework in the era of big data has failed.In the face of the platform's repeated use,analysis and sharing of data,the principle of consent after notification?reasonable expectation of privacy and the principle of third party have been impacted,so it is necessary to adopt a new perspective to look at the issue of personal information security.Big data prediction behavior and platform data manipulation behavior have a huge infringement on information self-determination;Data collection beyond the goal is a new privacy violation.At present,regulations on the use of personal information by network platforms are scattered in some departmental laws,lacking of strong and high-level legal regulations.The "privacy protection policy" formulated by the network platform is basically biased towards the network platform itself.How to use,desensitize,identify and protect personal data is relatively vague,but all of them spare no effort to let the user agree to let the platform collect,use and process personal data.On this basis,"scenario theory" and "privacy risk" are introduced to protect personal information security,and a dynamic privacy protection mode in essence is constructed.On the basis of benefiting social public interests and personal privacy interests,this paper further expounds the obligations of network platforms in the protection of personal information,and provides some Suggestions for the forthcoming data security law and personal information law of China.
