Research On The National Obligations Of The Protection Of Rights Of Children

With the development of industry in modern times,the rise of the civil rights movement and feminism,the legal status of children rapidly enhances,and the protection of children's rights issue also has been unprecedented attention.The level of international law has been,"Rights of the Child","Convention on the Rights of the Child","Vienna Declaration and Programme of Action”,etc.Our government has promulgated " Geneva Declaration Protecting Children "," Protection of Minors Act "," Compulsory Education Law ",and signed and implemented the " Convention on the rights of the Child ".In addition,the China government in 1992,2001 and 2011,respectively,issued the " China Children's Development Programme ",make the plan forchild development and the welfare issues,confirm child survival,development and participation rights,and absorbed the best interests principle about the child protection rights.The new " Code of Criminal Procedure” add juvenile criminal proceedings in 2012,but the phenomenon of child abuse still exist.This article start with some actual cases to national obligations of child protection rights as the emphasis,the child protection rights of the legal theoryand historicalanalysis as the starting point,the children rights protection as the theme,preventing child abuse as the viewpoint,the intention of this article is to expand the legal basisfor children rights protection from the theoretical level,and offering reference and consulting for the legal norms and practice of protection about children rights protection in practice to in order to for better protect the rights of our children.In the theoretical level,this article discusses about the basic human rights of children,the special status and special rights of children conduct de juredemonstration,to think that on the one hand,that the child is a citizen,should enjoy human rights in general,on the other hand,children are "special citizens ",the need to give special protection,the nationalobligations is indispensable.In practice,this article thinks that our government should perfect the legal system about protection of children's rights and interests,improve the parentage relations and the quality of relevant employees,change the traditional idea and respect the subject status of the children's rights,establish the special organization to prevent abuses and relief on child abuse,establish child protection agencies systemnationwide,establish special accusation mechanism to cooperate work with police,procuratorateand court to form the effective interaction and strengthen the national obligation.This paper consists of three parts;the first portion includes chapter one and chapter two,main analyzes the history and current situation of the children rights protection.The second part is the chapter three discusses the legal basis for the children rights protection,and the third part is the chapter four discusses children's rights protection system in China on the norm and the consummation of the mechanism.
