The Cyber-populism Tendency In Significant Legal Cases And The Ways Of Overcoming It

Populism phenomenon occurs in certain social transitional period,which is a response to social contradiction and has certain behaviors like the nature of grass roots,criticalness and non-rationality,etc.Internet makes populism phenomenon present new action logic,using extreme words to interpret all kinds of contradictions and conflicts occurred in China.The public focus on legal cases which have certain elements like opposition of officials and civilians,the gap between rich and poor,the reform of social institution,and require the judicial judgments in accordance with common moral standard which highlight the binary emotions of hating the rich,officers and intellectuals.The cyber-populism tendency in present China is a comprehensive phenomenon of social injustice,deficiency in judicial credibility,inefficiency of existing political system,short of citizen culture and imbalance in social structure,etc.which is a result of the accumulation and fermentation of various contradictions.The cyber-populism tendency has negative effects on judicial process,which interferes the judicial independence,affects the judicial fairness,restricts the judicial reform,and obstructs the common knowledge of ruling by law.In order to overcome the cyber-populism tendency,we shall eliminate social inequality,improve judicial own building,emphasis on Internet governance,foster citizen culture,and develop the ways and forms of political participation for people.
