Network Evaluation Caused By Violation Of Consumer Rights And Interests Problem Analysis

With the progress of network information technology and the popularity of Internet,great changes have taken place in the environment of network economy development in our country,especially the rise of taobao,make people in the network virtual platform business more prosperous.Online shopping convenience to people's life,and indeed boost domestic demand,increase the employment,promote the development of the economy,but in see it brings people huge economic benefits,we cannot be denied because of the complexity of the network economy and loopholes in the variability of science and technology lead to online shopping,there is an urgent need to solve the network in the evaluation of the contradiction between the seller and the buyer.This paper mainly discusses the network evaluation of tort and its solutions are put forward.This paper will be divided into four parts:The first part is introduction,mainly from the concept and characteristics of online and offline review of the concept,types,significance and the rule of online and offline review to introduce the basic.The second part mainly stated the net a review of the infringement of unhealthy phenomenon:fictitious consumer comments-"brush",hidden consumer reviews,forcing consumers to change bad review to retaliate against the buyer.Combined with the present prominent cases sellers specific behavior of infringement.And according to the bad phenomena in our comments on the typed analysis,involves the "contract law","elimination" of fraud as well as consumers' right to know,the right of personal security,editorial freedom,etc.The third part mainly analyzes the deficiency of the net in the evaluation of tort law regulation,the specific make analysis from three aspects:legislation,the low legal status and regulation effect is limited;The legislative lag,failure to form a network legal system;Justice,the jurisdiction is not clear,electronic evidence difficult;Insufficient capacity of law enforcement,law enforcement,Loopholes in credit evaluation mechanism,the network platform of inaction and consumer oneself consciousness weak.The fourth part for the third part of the problem put forward relief way.Mainly from the legislative,judicial,law enforcement,expounds the four perspectives:network platform at the legislative level,improve the legislative level,improve the existing laws and regulations;Accelerating special legislation,the electronic commerce legal system as soon as possible;In the law enforcement level,improve the level of law enforcement,strict law enforcement,building of the ministry of commerce and industry of the independent third party assessment mechanism.Intensify propaganda consumer law awareness,many joint efforts to establish safe and reliable online shopping environment.
