Study On The Constitutionality Of The Construction Of The Minzu Mutual Embedded Community

Since ancient times,China has been a multiracial nationalities.the establishment of new Chinese,and consolidation,development,harmony are struggled together by fifty-six peoples together.In the new century,with the spread of terrorism,ethnic extremism in the world,China’s minority areas affected by different degrees,therefore,the harmonious coexistence between minority and Han nationality,is still a matter of political stability,national stability,economic development and cultural prosperity.The main purpose of this research is,through mutual nationality community,the new policy of central conference,through the analysis of national embedded in each other between community and regional ethnic autonomy of the two system internal theory to explain the ethnic tension,the embedded community and the regional autonomy of ethnic minorities have certain similarities in the system,there are some contradictions and conflicts,through the reflection on the history of Chinese "human" and integration of resources of ethnic groups in a deeper interaction can be understood as the human and mutually embedded in the population floating era upset,.The history of each period Chinese social stability in fact always depends on the people living on regular earth,doing a regular job.promoting mutual nationality community should guide,should be encouraged,but enforced.This paper is China’s history(sixth part);the last part is epilogue.The first part is the introduction.The introduction of this article is divided into four sections.The first section is the background of the selected topic;the second section is the research significance of the topic;the third section is the research status and review.The second part,this part focuses on the target of the National mutual embedded type community.This chapter is divided into three sections,the first section focused on the definition of the national mutual embedded;the second section mainly introduces the national mutual embedding characteristics;the third section describes the target of the national mutually embedded type community is to promote the Han and minority ethnic minority areas in the living space of the mixed.The third part of this chapter explains the spatial foundation of Regional autonomy of ethnic minorities,this chapter is divided into three sections,the first section reviews regional autonomy of ethnic minorities’ theoretical and practical sources,points out Marx,Lenin about the national policy is the theoretical basis of the regional autonomy of ethnic minorities,political practice of the Soviet Union national self-determination is the practice source for regional autonomy of ethnic minorities,the system of Chinese regional ethnic autonomy is based on these theory and practice,combined with the actual situation of China.The second section introduces the development status of regional ethnic autonomy.The third section explains the space base is the foundation of regional ethnic autonomy,that is,in the space of ethnic groups,rather than in other placesThe fourth part,first section focuses on the contradiction between national mutual embedded and regional autonomy of ethnic minorities,that is the contradiction between minorities and Han nationality in space;in the second section,using the constitutional principle-legitimate purpose,principle of necessity and the principle of proportionality analyzes national mutual embedded theory in the form of constitutionality;in the third section,from the form of constitutionality to substantive constitutional issues,analyzes the ethnic interaction of citizens’ personal freedom rights,the rights of religious belief,political rights may have a negative impact.The fifth part,this part emphasizes the explained,but I do not know How and where,so in the end of the thesis,written here,write a summary for the graduation thesis.The seventh chapter is divided into two sections.The first section explains whether national mutual embedded can be regarded as a legal problem;the second section explains how to evaluate national political factors in the national mutual embedded theory.
