| National traditional sports is an important element of China’ s intangible cultural heritage.It is also the treasure of our traditional culture.National traditional sports is faced with the risk of being disappearing and deprived due to lack of legal protection,its demand is not met and respected,and it is being marginalized.Currently,our protection and salvage efforts towards traditional ethic sports is outpaced by its deterioration.Therefore,it is urgent of reinforce legal protection towards traditional ethic sports.This article,starting from the current protection status of National traditional sports and with the focus on dilemma of current legal protection,conducts a comprehensive research on the topic using documentary analysis,survey,logical analysis,and comparative studies.It first analyzes the history and origin of National traditional sports,its development stages and current protection status;secondly,its carries out an in-depth exploration and study on issues facing the practices of China’ s National traditional sports sports,education and heritage,laws and statutes,and policy systems.Through its investigation and research,it finds out that major issues related with legal protection of traditional Chinese National traditional sports are centered on lack of intellectual property and intangible cultural heritage protection,the ambiguity of the legal status for relevant organizations,lack of proper resolution mechanism for legal disputes,non-existence of sporting rules for Chinese National traditional sports,and lack of education heritage management,etc.Finally,based on the issues and problems discovered in the research,the article raises solutions and suggestions for resolving problems related with Chinese National traditional sports,namely,clarifying the legal status of relevant organizations and scope of intellectual property,establishing mature dispute resolution mechanism and organizing rules for sporting programs,and promulgating rules for sports education,etc.After establishing the rule of law,use the law correctly is the only way to thoroughly prevent the decline of the traditional sports protection.The author hopes that this article will provide intellectual support and policy making references for the protection and development of Chinese National traditional sports. |
