With the development of globalization and further promotion of the Belt and Road Initiative,legal translation has drawn quite some attention.Domestic research on legal translation,however,mainly focuses on the translation of judgments,legislative texts etc.,so much so that legal scholarly texts,as an important tool for sharing research findings and legal cultures,transplanting and/or reforming legal practices,fail to draw due attention.In this translation practice,the translator chooses Copyright Enforcement in the Digital Age: When the Remedy is the Wrong as the source text.This article,which is a comprehensive empirical study of copyright statutory damages in the USA,examines the widespread practice of overclaiming of remedies in copyright litigation,and formulates policy proposals to address the problem,which may provide reference to the copyright enforcement in China.Based on the text type and features of the source text,this report analyzes the translation practice at the lexical level,syntactic level,and textual level.The translation of common words with legal meaning,compound words,long and complex sentences,negative sentences,and annotations is discussed under the guidance of translator subjectivity in an attempt to contribute to future translation of such scholarly legal texts.With the case analysis,the translator finds as follows.In translating words,especially the common words with legal meaning,the translator should pay special attention to the context to avoid misunderstanding for conventional thinking.In translating sentences,it is important for the translator to take into consideration the style of the target language and to decide whether to change the original negation in the case of negative sentences.With regard to the translation of annotation in scholarly texts,the translator may consult relevant leading journals in the target language to decide the translation method,and adding notes is recommended if necessary.
