The relationship between law and literature has always been the focus of interdisciplinary research by law scholars.Analyzing the works of a particular writer is the basic way of this research.In some literary works that embody legal thoughts,Kafka's "Lonely Trilogy" is particularly noticeable.Kafka(the lawyer who received law degree,and devoted himself to insurance business for life)is also one of the greatest writers in the 20 th century.He is the representative person who integrated law achievements with literary.His most representative novels "America","Action","Castle"(Kafka's Lonely Trilogy)show the differences and commonalities between law and literature from the aspects of content,form,thoughts etc.This paper takes Kafka's "Lonely Trilogy" as an example to explore the relationship between law and literature.Specifically,this paper mainly discuss the relationship through the aspects of the research status of "law and literature movement" at home and abroad,the content and the research situation of Kafka's Lonely Trilogy,the legal matters and the relationship between law and literature of Lonely Trilogy to discuss the relationship thus to further study the effective ways to solve practical legal matters through seeking common ground while reserving differences between literature and law.Among them,the top priority of this paper is to discuss the presentation of "the law in literature" and "the literature in law"(as the law of literature)of Kafka's "Lonely Trilogy" based on these two ways of("the law in literature" and "literature in law")current research of relationship between Chinese law and literature."The law in literature" reflects the general problems of legal theory and legal practice through the interpretation of literary works;and "literature in law"(as the law of literature)applies the writing and interpretation of literary text to the analysis of legal text and the use of legal knowledge.Through the comprehensive interpretation of Kafka's "Lonely Trilogy" as a literary work,the author mainly interprets the concepts of "secret accusation","trial procedure","legal rights" and "justice and social institution" understood by the author."America","Lawsuit" and "Castle" also let the author understand the effect of the expression for "law and freedom" on legal concept,and the settlement effect of " intertextuality " on the intellectual property rights.By comparing the similarities and differences between law and literature and studying the organic integration of them to fully study the interaction between law and literature.As a legal person,the author adds another beautiful scenery line in law area by combining the law and emotion,principle and concern,law and humanity,specialty and personality,and studying them out of traditional law concept,absorbing nutrients in the literature,polishing law with literature,showing humanity through sound law system,which are based on the study of the comprehensive relationship between law and literature to fully integrate law with literature.
