Family is a collection of social relationships,marriage is the foundation of people's life,in the early days of the People's Republic of China,especially1950-1953 is an important period of social transformation in China.During this period,China's politics,economy and society were in a huge stage of morphological replacement,the Marriage system as a part of the social system has also undergone major changes.Previous research on marriage and family,the academic circles mainly study the changes of marriage and family,the implementation of the marriage law,and the history of marriage legal system from a macro perspective.And there is relatively little research on the divorce tide after the founding of the People's Republic of China,divorce as part of the modern marriage category,not only part of the history of the marriage system,but also an important aspect of social structure.This paper makes use of the civil litigation files of the 1950-1955 People's Court of Y City,Shanxi Province and the archives of Shanxi Provincial Archives in the early days of the founding of New China.Taking the divorce tide in Shanxi Province as the research object,it focuses on the emergence causes,characteristics and new problems surrounding the divorce in Shanxi.Due to the promulgation of the marriage law,especially the deliberate emphasis on the concept of freedom of marriage,litigation cases caused by divorce continue to emerge,this made Shanxi the first divorce climax after the founding of the country.Although the realization of the freedom of divorce shows that the state has broken the old marriage system and tradition to some extent by the power of law and administration.However,freedom of divorce as a kind of "liberation" is not easy,and encountered various obstacles in the specific implementation process.Some new social problems have arisen.This article aims to focus on the issue of divorce.It is intended to indicate the achievements and problems in the implementation of the Marriage Law after the founding of the People's Republic of China,provide a reliable comparison of today's marriage life,inorder to provide more thinking and reference in the face of the social problem of divorce.
