A Study Of Divorce In Tianjin At The Initial Stage Of The Founding Of New China

With successively victory of war of liberation,the Communist Party of China in 1948 started the new marriage law legislation.As liu shaoqi said,"after the founding of new China,we can not live without a marriage.We such a big country,more than five hundred million people,would be disordered without a marriage law." The Marriage Law of the People's Republic of China was finally promulgated in 1950 after the unremitting efforts of the Chinese communists.In chapter 1,article 2 of the law clearly stipulated that the marriage system of free choice of partner,monogamy and equality between men and women shall be practised and that the lawful rights and interests of women,children and the elderly must be protected.This one was enough to break the marriage system of the old society,fully gave young people the right to freedom of marriage,rejected polygamy,patriarchy and even the abnormal marriage,such as child marriage,concubine,rent marriage,change marriage,child bride,etc.What's more,marriage of new-democratic marriage system was formally established.Especially the oppressed women in the marriage for a long time began to get rid of the old marriage and began new journey to the pursuit of happiness.Since then,the country has begun to lift a wave of divorce in the theme of abolishing feudal marriage and liberating women.This paper is focused on the historical background,to reveal the real marriage life and to present the divorce problems and characteristics in the process of propaganda to implement the marriage law behind the wave of the divorce in Tianjin area.Studying these problems and characteristics of Tianjin can make us grasp,after the founding of new China,the process of the old and new alternation and struggle of the idea of divorce,the formation of the new institution of marriage and the establishment and perfection of the judicial system of marriage in Tianjin.In addition,the marriage system in the typical area of Tianjin can also be used to explore the process and problems of the changes in the marriage life of women in Tianjin.The research methods of this article are mainly the literature analysis,qualitative analysis,case analysis and other research methods.Using concrete analysis based on specific issue and using different research methods according to different materials make every effort to accurately and clearly reflect related issues and to ensure this article with tight logic.This article first clearly presents,through the summary of the problems of Tianjin divorce in the Republic of China and the intruduction of marriage movement of the Republic of China,the legislative process,implementing process,the divorce rate and characteristics of divorce,the modern Tianjin people's tough pursuit of marrige freedom and equality between men and women and thus the marriage condition of modern Tianjin obtained the very big difference.After the founding of new China,under the guidance of the Communist Party of China,the related department has first carried on the detailed investigation,summarized predecessors' experience and used the experience of the Soviet Union,then demonstrated repeatedly,and finally established the The Marriage Law of the People's Republic of China.The law provided a legal basis for the Chinese people to abandon their old marriage and seek real marriage freedom and equality.Since then,a wave of divorce has been lifted in China.This paper introduces in detail the legislative process of the new marriage,studies the divorce issue in Tianjin in the process of publicity and implementation of the law and summarizes many related data into tables,in order to more clearly observe marriage and family changes in Tianjin.Also,arising problems and accumulated experience in the process of the establishment of the new marriage system in Tianjin was summarized.Based on this we know that,during the first wave of divorce in the new China,the problems and the solutions Tianjin faced are diversiform and the typical representative.So the study of Tianjin divorce problem,in the early period of the establishment of the People's Republic of China,is a good way to enrich social history research,to provide some support in the aspect of theory in future divorce studies.At thesame time it has some similarities to marriage legislation,reform of the system,the women's liberation and so on.Therefore,the research of this paper can provide an effective supplement or side confirmation to the above related fields.
