The translation of academic works is of great significance to the exchanges of human politics, ideology and culture, and even to the social changes. Therefore, studying academic translation has been endowed with positive significance.Guided by the Eugene Nida's theory of "functional equivalence",this report is based on the translation of Rhetoric and La—the Arts of Culture and Communal Life,an essay written by James Boyd White,an American jurist, aiming to discuss how to do academic translation well under western rhetorical theory's instruction. In the source text,White expounds how to"think of law as a rhetoric",and points out that law is culture-specific,communal and socially constitutive. As the legal language and the literary language have some common features in rhetoric,White thinks that law should be conceived as "an art of rhetoric"from the perspective of rhetoric, and also suggests a way to think about rhetoric, especially about the "constitutive" rhetoric.Under the direction of theory of "functional equivalence",this report is aimed at elaborating how to achieve functional equivalence between the source text and the target text from the layer of vocabulary, syntax and rhetoric through case analysis, combined with my own translation practice.Besides, relevant translation skills and strategies available in English-Chinese translation are also put forward and discussed in detail to resolve corresponding problems in the translation process. Finally, the author points out the shortages in research and outlooks for the future,so as to make a theoretical summary for this translation practice.Through this English-Chinese translation practice, the author hopes to improve her own theoretical attainment and translation competence, and provide some reference for domestic academic translation in terms of translation strategies.
