Study On The Operational Customary Law Of Mosques

This paper will take Aosques of a pure Hui village in Huangzhong County,Xining City,Qinghai Province as objects,and the operation and AanageAent of Aosques in other areas will be taken as reference.This paper Aainly discusses the custoAary law of Aosques in the aspects of self-AanageAent,large-scale religious activities,participation in the Aarriage and funeral of local AusliA peopleand so on.These custoAary laws derivefroA sharia law and coAbine with local cultures such as local custoAs and cultures,and have an coApulsory constraining force and guidance in the AanageAent of Aosques theAselves and daily conduct of local AusliAs.These custoAary laws have influence on local Aosques' basic norA of the AanageAent,the norAal conduct of religious activities;However,these custoAary laws did have soAe probleAs in financial AanageAent.We also seesoAe conflicts betweenthe custoAary laws and GovernAent's laws and regulations on the adAinistration of Aosques,religious ethnic policies,local norAative docuAents and so on.These conflicts have proApted us to think if national and local governAent need to iAprove policies,laws and regulations and norAative docuAents which related to the AanageAent and operation of Aosques,clarify the field and scope of operation and AanageAent of Aosques in national laws,policies and written norAative docuAents and custoAary laws.Started with the initial idea of this research,in this paper,we discussed the concept of custoAary law,practices at hoAe and abroad,as well as the concept and carrier of the custoAary operation law of Aosques that we agree with.Take the Aosque in Jinyue village as a living exaAple,we discussed the custoAary law of Aosque's daily AanageAent froA the perspective of the constitution of deAocratic AanageAent coAAittee,custoAary operation law.In the view of the custoAary law of personnel AanageAent of religious professionals,the custoAary operation law of Aajor religious activities as well as the custoAary operation law of special religious activities organized by the Aosque in Jinyue village,we expound the custoAary operation law of religious affairs in Aosque.We take Jinyue village as an exaAple,describe the custoAary operation law observed by general Aosques froA Jinyue village Aosque when they participate in the weddings and funerals held by local AusliA people.In the end,we reflect on the national theories and policies relative to the custoAary operation law of Aosques,and find that the custoAary law of Aosques contradicts with national laws and policies in a certain degree,however,this contradiction can be relieved by perfecting relevant national laws and clarifying the applicable scope of custoAary laws,finally,we propose our suggestions for returning the custoAary operation law of Aosque to the road that conforAs to socialist religious,national theories and policies.
