The Case Study And The Reality Enlightenment Of Field Disputes In Nanbu County Of Sichuan In The Qing Dynasty

As the most basic element of agriculture,land has an indispensable role in the development of a country.Whenever and wherever,all issues involving land are very important.As far as agriculture is concerned,fields are the most important part of land.In the vast rural areas of China,the most common land dispute is a field dispute.Exploring the proper scheme of rural land disputes has an important significance in protecting the legitimate rights and interests of both parties,promoting the development of China’s economy(especially the agricultural economy)and maintaining social stability and unity.With the view to provide some references for the current civil disputes(as an example of field disputes)settlement in China,starting from the legal perspective,centering on Nanchong City of Sichuan’s Nanbu County archives,refering to Sichuan’s Baxian archives and other archives in the Qing Dynasty,and supplemented by "Qing law" and other historical materials,this paper attempts to explore the types and characteristics of the land management system and land contract and a variety of field disputes is how to be properly addressed in Nanbu County of Sichuan in the Qing Dynasty by studying to the field disputes recorded in the Nanbu County archives.This paper has five parts :The first part is introduction,mainly elaborated the topic significance,review the academic history,research methods and innovation.The second part is also the chapter two “The background of the field disputes in Nanbu County of Sichuan in the Qing Dynasty and the Nanbu County archives”.Firstly,introduce the classification of land types in the Qing Dynasty.Second,discuss on the civil life of the people in Nanbu County of Sichuan in the Qing Dynasty basing on the background of civil dispute activities in Nanbu County of Sichuan in the Qing Dynasty and the civil dispute cases in the Nanbu County archives.In the end,the Nanbu County archives is briefly introduced.The third part corresponds to the third chapter of the paper “ The official law and customary law of field disputes in the Qing Dynasty”.In this part,on the one handbased on the specific laws,such as the law of the Qing Dynasty,analyze the laws and regulations of the field disputes in the Qing Dynasty;on the other hand,Taking the cases of field disputes in Nanbu County of Sichuan in Qing Dynasty as an example,discuss the customary law order of the land disputes in the Qing Dynasty.The fourth part corresponds to the fourth chapter “The situation and treatment of the field disputes in Nanbu County of Sichuan in Qing Dynasty”.In this chapter,firstly,give statistics and analysis of the main types of field disputes in Nanbu County of Sichuan in Qing Dynasty basing on the Nanbu County archives.Next,analyze the similarities and differences between the “field trade” in the Qing Dynasty and the“transfer of the rural field contractual management right”,as well as the “field infringement” in the Qing Dynasty and the current “field infringement”.Last,probe into the handling of field disputes in Nanbu County of Sichuan in Qing Dynasty by using the typical cases.The fifth part is the fifth chapter “the reality enlightenment of the handling of field disputes in the Nanbu County of Sichuan in the Qing Dynasty”.In this part,provide some references for the current civil disputes(as an example of field disputes)settlement in China basing on the above discussion about the treatment of diversiform field disputes in Nanbu County of Sichuan in Qing Dynasty.
