A Report On The Translation Of Tort Law In Hong Kong

Law is a social norm that is enforced by the state’s coercive force.It is necessary to learn local laws under different jurisdictions which have their own applicable laws.Tort law in Hong Kong,a major branch of laws,plays an important role in settling economic disputes caused by torts.Thus,with the increasingly close communication between Hong Kong and Mainland China,the translation of studies on tort law in Hong Kong may help promote Mainland Chinese?s understanding of it by people from Mainland China.This is a report on the translation of excerpts from Tort Law in Hong Kong.The three chapters chosen as my translation materials include “introduction”,“types”,and “tort of negligence”.This report mainly discusses the translation of the above-mentioned materials on the basis of the adaptation theory proposed by Verschueren.According to his theory,language use is a dynamic process of adapting to the context and the structure of language at different levels,which means constantly making linguistic choices.Under the guidance of adaptation theory,my translation dynamically adapts to the Chinese legal context,hence to find a balance between the objectivity of language and the readability of the content.This report mainly discusses the problems in translation of terms and subjects encountered in the translation process.Since Mainland China and Hong Kong have different legal systems,some English terms in the source text have no equivalents in Chinese.Thus,I have employed annotation,substitution and other strategies in order to adapt these terms to the Chinese context.In addition,I have adopted reordering,omission,transfer and other strategies to flexibly handle the difficulties in translation of subjects.I wish to make some contribution to legal translation through my practice.
