A Study On Translation Of Fidic Contract From The Perspective Of Functional Stylistics

In economic activities,the role of contract is important.In the behavior of the two contracting parties,the contract is its criterion.In the event of an economic dispute,the contract is the legal basis for regulating,arbitration or litigation,which is directly related to the interests of the two parties.In the translation of contract,any improper understanding or inaccurate expression of the contract may damage the interests of the two parties or one party,which leads the economic activities unnormally.In the management of foreign engineering construction,most projects are managed by FIDIC contracts.However,the use of FIDIC contract is still not common in China,because no matter the owner,the supervision engineer or the contractor,the people who can fully understand the English version of the FIDIC contract are still a few.Therefore,the study of the Chinese translation of FIDIC contract has become a new topic.As a modern stylistic theory,Functional Stylistics provides a new perspective and method for stylistic analysis.Many works have been done on the literary materials under the guidance of this theory with remarkable achievements.This thesis holds that Functional Stylistics is also suitable for the stylistic analysis of FIDIC contract,thus guiding the translation of FIDIC contract.In light of The Standard Power Purchase Agreement of The National Transmission and Despatch Company Limited,with the guidance of metafunction in Functional Stylistics,this thesis makes a comprehensive analysis of the stylistic features of FIDIC contract from the lexical,syntactic and textual level.Through these studies,we can better reveal the stylistic features of FIDIC contract,and discuss the translation of the contract through an example,and summarize the translation strategies that should be followed in the translation of FIDIC contract and the problems that should be paid attention to.Through analysis,the main research results are listed as follows: as for FIDIC contract,the prominent stylistic features in lexical level are the formality and the collocation;the prominent stylistic features in syntactic level include: the length and complexity and the frequent use of conditional clauses,passive voice and negation device;the prominent stylistic features in textual level are the coherence and the completeness.With the guidance of Functional Stylistics,this thesis holds that the translation of FIDIC contract should follow the principleof faithfulness and expressiveness.On the one hand,we should properly adopt the accuracy principle,conciseness principle and normalization principle,to show the formality,authority and accuracy of the FIDIC contract and their translation;on the other hand,we should adopt the rule of repetition,reservation,transformation and split translation,so as to achieve the coherence of FIDIC contract and keep the consistency of FIDIC contract and its translation.
