In the modern sense,a lawyer is a practicing person who obtains a lawyer's practicing certificate according to law,accepts the entrustment or designation,and provides legal service for the client.However,lawyers in China are exotic exports after the Opium War.Shanghai opened first after the Opium War,and the earliest lawyers in mainland China also appeared in Shanghai,-from the enterance of foreign lawyers to local lawyers after the Revolution of 1911.And Zhejiang Province,as a neighbor of Shanghai,is called the "cultural state" since ancient times,the Shiye and Songshi of Zhejiang ind Ming and Qing Dynasties are famous throughout the country,some of them are even full of legendary.After the Revolution of 1911,a group of talents from Zhejiang who born out of the traditional Pettifogger and received a modern legal education,enjoyed their talents at Shanghai,where the first land opened in morden China,and worked a lot as lawyers,leaving A heavy color of the pen in the history.This paper attempts to collect the catalogs of the Zhejiang lawyers at Shanghai in the period of Nanjing National Government as much as possible to return their life stories,and to analyze the overall status and historical contribution of the group at that time,as well as the construction of the rule of law in Shanghai and Zhejiang Social welfare aspects of the practical role,with a view to a three-dimensional,systematic research results.This article consists of introduction,four body chapters and conclusion.The paper introduction intoduced the reasons of choosing this tiele,briefly reviews the current research situation,expound the research methods,in order to seek the research direction and writing space.The first chapter,summarizes the overall situation of Zhejiang lawyers in the period of Nanjing National Government at Shanghai,and analyse the background information of the Zhejiang lawyers such as education and birthplace,to conclude the characteristics of the background curriculum.Then analyse the political,economic,social and legal aspects background at that time,hope to have a certain understanding of its overall occupational status characteristics and social history status and influence.The second chapter focuses on its specific practice.From civil litigation,criminal proceedings,legal advisers and non-litigation business according to the modern legal practice of lawyers and the legal status of the whole nation and Shanghai at that time,we can see that in many major cases,there are signs of Zhejiang lawyers.For instance,civil litigation,there is a big case of debt disputes which concerned with the mighty Rong Family.In the field of criminal proceedings,Zhejiang lawyers can be seen in several cases of traitors and the "seven gentleman" case.As legal advisers,some of them served for the well-known publishers such as Commercial Press and so on.In addition,there is a phenomenon that Zhejiang lawyers had a considerable proportion of the Shanghai Bar Association executive level.In particular,we are fortunate to see their professional situation from another side through the novel of Su Qing,who was the wife of a Zhejiang lawyer.Through the review and summary of these cases,we ar able to explore the Zhejiang lawyers at the time of Shanghai's business level,status and influence.The third chapter is the the work and life outside their lawyer business.As to the teaching and research,some of them were professors in universities and colleges who loved by the students.They did not only teach students knowledge,but also promote them progressive thinking,forged a lifetime friendship;some possessed profound legal theory and had written many works to his credit.In the face of the turbulent society at that time,they also cherished a patriotic heart,with their own practical actions for the motherland's independence and prosperity to dedicate their own strength;or take the initiative to help those vulnerable groups who need help.And when they face difficulties themselves,they always help each other,tide over the crisis.The fourth chapter analyzes the problems and shortcomings of Zhejiang lawyers in the period of Nanjing National Government at Shanghai from two examples of actual characters.These problems and deficiencies are only individual,but in many respects we deserve our sincerity todayFinally,the conclusion is the part of a high degree of summary and sublimation of the above contents.
