Study On The Causes And Countermeasures Of Collective Forest Rights Disputes In Jiangyuan District Of Baishan City

Baishan City is one of China’s main timber producing areas.In July 1994,the Ministry of Forestry approved the establishment of a full-scale national forest tourist area in Baishan city.Jiangyuan District of Baishan city,as a key forest region and county in Northeast China,has an area forest coverage rate of 83% and is an important processing base for forest products in Northeast China.The area of arable land owned by farmers in Jiangyuan District is very small.Forestry income is the main source of farmers’ income,and farmers are highly dependent on forestry.During the reform of the forest tenure system,the property rights of the forest land and the application policy of the property rights have changed,and the development of the forestry economy of the farmers has also changed.The conflicts of collective forest rights have become more prominent.It causes a burden and also affects the rural economic development and forestry economic progress in the Jiangyuan District.This study sorted out the reform of the forest tenure system in Jiangyuan District,sorts out,and collective forest rights disputes,compiles questionnaires and conducts empirical analysis,in order to discover the development characteristics of collective forest rights disputes and collective forest rights disputes.The influencing factors provided suggestions for deepening the forest tenure system reform and management of collective forest tenure disputes in the Jiangyuan District,reducing the risk of farmers’ forest land application in the Jiangyuan District,and promoting the development of forestry economy.The research adopted the literature analysis method,organized the relevant literature of the collective forest right dispute,determined the research method and the research idea,defined the basic concept,determined the theoretical basis of the research,used the data analysis method,collated the reform of the forest right system in Jiangyuan District,described the basic situation of the collective forest right dispute,and used the questionnaire survey method.This paper described the current situation of forest rights disputes in this area by describing the statistical analysis,and then used logistic model to analyze the factors of forest rights disputes,and put forward some suggestions for countermeasures.The study found that the application of forest land resources in Jiangyuan area promoted the development of forestry and became an important factor in the development of rural economy.Based on the forestry armed solutions,from 2008 to 2018,"area of forest right reform have experienced three stages,the reform further determind the forest land property right form,made the forest land property right which was more complete,cleared forest land borders,promoted the development of forestry economy and forests,promoted forest land property rights circulation of standardization,and made the nature of real right of forestland property rights clear.In the process of forest right reform,there were collective forest right disputed in jiangyuan district,which can be divided into four categories: forest right ownership disputes,property right type disputes,forest right use disputes and forest right contract disputes.In different stages of forest right reform,the number and types of forest right disputes were also different.Most of the peasant households in jiangyuan district had never had any disputes over forest rights,and their cognition of collective forest rights,the area of woodland and the number of woodland plots,the use of forest resources by peasant households and the settlement of disputes over collective forest rights have all had an impact on the disputes over collective forest rights.The higher the cognition degree of farmers’ collective forest right,the less likely they were to have disputes.The larger the woodland area and the more the woodland land,the more likely they were to produce disputes.The higher the demand of farmers on the economic value of forest resources,the more likely they were to have disputes over forest rights.The more complicated the settlement procedure was,the higher the cost was,and the less likely it was to produce forest right disputes.According to the above research,the conclusion was put forward to strengthen the propaganda of forest right system reform in order to improve the farmer’s perception of forest right system reform,the formation of forest land use reporting mechanism,and guide farmers to realize the rational allocation of forest resources,optimize the forest right approach,attache great importance to the application of customary law.According to the features of collective forest tenure reform and development,in the process of establishing forest land property right application contract formulation and related countermeasures and Suggestions.
