The new "Land Administration Law of the People’s Republic of China" was formally implemented on January 1,2020.This revision provides legal support for the collective non-farming construction land to enter the market,and changed the issue that collective land must be requisitioned to be state-owned in order to be transferred.This changes have caused the supply methods and supply subjects of collective non-farming construction land required for the implementation of urban and rural planning.So planning also needs to change accordingly to adapt to the changes.Based on this,this paper takes cost-benefit analysis as the main method,to explore the impact of the marketization of collective non-farming construction land on regulatory planning.Taking Xihongmen Town as an example,this paper optimizes it’s regulatory planning,and discusses the compilation method of the regulatory planning which takes into account the farmer’s interests and public interests under this background.Based on the analysis of the characteristics of the types of the marketization of collective non-farming construction land,this paper sums up its general characteristics,and puts forward the basic principles for the compilation of regulatory planning.Then,this paper summarizes the basic situation of Xihongmen Town and the process of the marketization of collective non-farming construction land.Through the analysis of relevant planning,this paper finds out the problems of it’s original regulatory planning of collective non-farming construction land.Then,based on the cost-benefit analysis,this paper analyzes the cost-benefit situation of the stakeholders in the process of the marketization of collective non-farming construction land in Xihongmen Town,and finds out the core stakeholder,namely,the associated company.Based on the principle of protecting the interests of the associated company,the total development amount of the collective non-farming construction land is determined.Finally,by using the cost-benefit analysis of associated companies,the regulatory planning of collective non-farming construction land in Xihongmen Town is formed from three aspects: the determination of land use scale,the optimization of spatial layout and the construction of flexible plot ratio.Through the research of this paper,we found that:(1)The regulatory planning of the collective non-farming construction land needs to protect the collective interests of farmers first.Therefore,in terms of the technical methods of regulatory planning,it is necessary to strengthen the economic calculation,determine the total development amount that can protect the basic interests of the farmers through cost-benefit analysis,and put forward the basic lower limit requirements for the next step.(2)After determining the lower limit of the total development amount,it is necessary to implement the spatial layout and define the control index under the guidance of the upper level planning.In the process of spatial layout,we should actively accept the suggestions of farmers,and balance the interests of farmers and public through the way of plot ratio interval.(3)In the index management,we need to increase the management flexibility,and make the final index flexibly according to the actual situation of the marketization of the collective non-farming construction land.
