Engineering change is inevitable in the process of EPC project implementation,and the incompleteness of contracts under EPC mode makes engineering change bring a series of negative effects for construction projects,such as out of control of investment and extension of construction period,and intensifies the contradiction between the two parties involved in the contract.Research scholars show that rights have the ability to respond to potential engineering changes,and reasonable allocation of control rights can flexibly respond to uncertain events in the implementation process,so that engineering changes can be controlled.However,in practice,there exists the decision-making dilemma of whether the change of control is strong or weak,that is,the owner adopts the weak change of control,which increases the possibility of the contractor's opportunistic behavior;if the contractor adopts the strong change of control,the flexibility of the project to deal with the probable events becomes worse.Based on this,this paper explores the appropriate control of engineering change clauses from the perspective of contract performance efficiency.This paper mainly includes the following research contents:Firstly,this paper deconstructs engineering change into two parts: engineering change control and engineering change price adjustment by using the method of checking the literature.Summarize and conclude the terms of control right of engineering change,including the proposal of engineering change,the approval of engineering change items and price,the approval of reasonable Suggestions of engineering change price adjustment and the reward coefficient of revenue sharing.Secondly,engineering change clauses affect the implementation path of the contract.Using semi-structured interview and grounded theory,based on the analysis of the change of control clause of EPC project,this paper constructs the performance efficiency index and quantifies the evaluation of contractor's performance.On this basis,a model of the influence of engineering change clauses on the efficiency of contract performance is built.Finally,it is found that :(1)the engineering change clauses with complementary strengths can improve the efficiency of contract performance;(2)the engineering change clause with strong control rights can reduce the opportunistic behavior of the contractor and make the contractor turn the opportunistic behavior into literal performance behavior and then turn it into perfect performance behavior through incentives;(3)relax the control intensity of the change clauses related to the project price,so that the contractor can transform the literal performance into perfect performance,thus improving the efficiency of contract performance.Finally,based on the incomplete contract theory about the basic theory of the external governance and internal governance,this paper puts forward the external governance mainly from the recovery after the project management triangle,strengthening the construction drawing review,establishing evaluation system for project information sharing platform and change,and build turnkey angles such as strengthening the cooperated-builing parties service information evaluation system engineering change control study;Internal governance mainly from the point of view of engineering change the terms of reconstruction,setting strength complementary terms of the engineering change control,supplemented by a reasonable change risk sharing in the contracting phase are added to the contractor fairness perceptions,eliminate the contractor speculative psychology,urge the contractor to make up for the loopholes of the contract,take the attitude of cooperation in the performance of the contract performance.
