Discovery And Research On The Claim Opportunity Of Contractors Under Fidic Contract Condition

In recent years,with the initiative of “One Belt,One Road” proposed by President Xi Jinping,the number and scale of China's foreign engineering contracting projects have been continuously improved.However,foreign engineering projects involving Chinese construction enterprises generally have large scale projects,complicated construction conditions,relatively long construction period of project construction,etc.,and the construction project itself is susceptible to external factors,so the project may face many uncertainties.Factors that cause the contractor to claim an incident.The FIDIC contract clause is a relatively common contract clause used in international projects.Facing the FIDIC contract,the project contractor timely discovers the claim opportunity and makes reasonable and effective claims.It is especially important for maintaining the contractor's own rights and interests,because the claim opportunity event is often the interference project.The events of the process,so it is in the interests of the contractor to take reasonable measures.From the perspective of the construction contractor,this thesis expounds the concept and characteristics of the engineering claim and the various situations of the claim for the contractor under the FIDIC contract conditions,starting from the discovery and identification of the contractor's claim opportunity.To summarize and summarize the contractor's claim opportunities contained in the FIDIC terms,and to screen out 20 factors of claim opportunities.On this basis,six factors are summarized,including: owner factors,contract factors,and construction conditions.Economic factors,political and geographical differences,and force majeure factors.The Analytic Hierarchy Process(AHP)is used to analyze the opportunity factors of these claims,and establish an index system for the contractor's claim opportunity.According to the ambiguity characteristics of the claim opportunity factor,combined with the fuzzy comprehensive evaluation method,the fuzzy comprehensive evaluation theory's claim opportunity analysis and evaluation model is established,and the fuzzy analytic hierarchy process(F-AHP)is used to analyze the engineering contractor's claim opportunity factors.Finally,combined with the example of China's engineering contractor HWE company in the Middle East Y country H project,theclaim opportunity evaluation model is established,and the model is theoretically tested.After discovering and identifying the project contractor's claim opportunity factors,analyze and evaluate the claim and find the claim.The key factors of opportunity,put forward specific countermeasures,and provide ideas and experience for the contractor's claim management work.
