Research On Reform Of Local Environmental Law Enforcement System

In recent years,China has witnessed the sputter of economy and distinguished improvement of living standards.However,the pollution of ecological environment has become increasingly severe,which has seriously affected the people's pursuit of a better living environment.Targeted on the issues embedded in the original environmental protection system,CPC Central Committee decided to launch the reform of Environmental Law Enforcement System(ELES).Since 2016,the State Council has issued the ‘Guidelines on the Pilot Work of Vertical Management System Reform of Monitoring,Supervision and Law Enforcement of Environmental Protection Institutions on the Provincial Level' along with ‘Guidelines on Deepening the Reform of Comprehensive Administrative Law Enforcement of Ecological and Environmental Protection',including the vertical management system reform of monitoring,supervision and law enforcement of environmental protection institutions on the provincial level and below.Followed by the comprehensive Administrative Law Enforcement reform of ecological environmental protection on the horizontal level,in order to improve the efficiency of environmental law enforcement and the ecological environment amelioration through the reform.At present,the process of the reform is speeding up nationwide.This paper illustrates the reform of ELES in J City mainly from five aspects.The first part is to outline the main content and theoretical support of the reform of ELES by elaborating relevant concepts and theoretical basis.The second part studies the background of the reform of ELES in J City,analyzing the development process of environmental law enforcement in J City and the problems that need to be solved urgently before introducing the reform.In the third part,the current situation of the ELES reform has been reviewed,which illustrates the evaluation of the progress and effectiveness in terms of J City.The fourth part combines the progress of the reform in J City and compares the reform of other departments,analyzing the problems and reasons behind the reform.In fifth part,it offers the solutions regarding efficiency improvement,strengthening the implementation of local government's environmental protection responsibility,comprehensive environmental law enforcement supervision system improvement,strengthening the legal guarantee of ELES reform,and strengthening theconstruction of environmental law enforcement team.
