On Chinese Environment System

Our environment enforcement work is facing a serious situation which is “onelow two high three difficulties”. Faced with environmental problems in lawenforcement, either Premier Ministry or national Environmental Protection requestthe environmental enforcement should be as steel as hard, and never be soft as tofu invarious occasions. Therefore, there is a pressing problem facing the environmentalprotection work, which is how to strengthen environmental enforcement, and how toimprove environmental quality. Research on how to improve our environmentalenforcement system and to enhance the environmental law enforcement agenciesorganizational skills is an issue of great significance.Based on China’s national conditions, development of basic social institutionsand practices environmental law enforcement in recent years, this paper analyze andsynthesize mainly through a large number of books and papers, refers to related topicsfor domestic and foreign research ideas, compared to other countries in environmentalenforcement and learn from the advanced experience, the paper summarize thedefinition of environmental enforcement system, discuss China’s environmentalproblems in the law enforcement system, analyze the intrinsic connection in mainstructure, reveal the trends of environmental enforcement, and make more scientificand efficient “administration plus justice” law enforcement model which can beapplied to environmental enforcement in field of vision who has strong publicparticipation, high degree of democratization, law enforcement effectiveness, strongexecution capability and other features and advantages. The model of“Administration plus Justice” is suitable for China’s national conditions, meets therequirement of environmental enforcement under the new environmental enforcementmodel, is the trends and the best choice for environmental enforcement.
