Maritime emergency occurred frequently in recent years,the Marine environment and ecological resource pollution is increasingly serious worldwide,Marine environmental pollution emergency impact of environmental pollution has caused various countries,attaches great importance to the Marine environment pollution will directly or indirectly harm in accordance with the sea fishermen,born of the personal safety and property safety.In Marine environment pollution incident,the sudden large Marine environmental pollution events threatening,wide pollution and spread fast,at present our country's Marine environmental pollution emergency management laws and regulations is not perfect,there are contingency plans lack of responsibility system,information disclosure is not timely,and many other issues,the protection of Marine environment needs to be strengthened.Based on the legal mechanism of sudden Marine environmental pollution emergency management as the research object,to comb the theoretical concept,to our country's current legislative situation and the analysis of the legal system of Marine environmental law problems of emergency management,through the legal analysis and case study,summarizes the legislative Suggestions of the Marine environment emergency management,perfect the legal mechanism of emergency management.The first chapter is a theoretical overview.This paper mainly sorts out the concepts and characteristics of Marine environmental pollution incidents and emergency management,summarizes the participants of Marine environmental pollution emergency management,and summarizes the relevant contents of the legal mechanism of emergency management through legal norms.The second chapter analyzes the legal problems of emergency management.Sudden Marine environmental pollution in our country from the Angle of legislation,this paper researches the event emergency management related problems of the legal mechanism,the lack of liability mainly includes contingency plans and between law enforcement authority and information disclosure and reporting and aftermath of the unified perfect mechanism is insufficient,not in time and through research andanalysis of actual cases in recent years,increasing its empirical.Chapter three is the reference of foreign experience.Taking the Marine environmental emergency management in the United States,Japan and Canada as examples,this paper analyzes the legislative status quo,and summarizes the legislative experience applicable to China from the aspects of diversified main body participation,emergency plan and information disclosure.The fourth part is the legislative proposal and consummation.Based on the foreign experience in chapter iii,this paper aims at improving the legal problems of Marine environmental emergency management proposed in chapter ii,including improving the responsibility system of emergency response plan,realizing the participation of diversified subjects in emergency management,improving the legal system of information disclosure,and implementing the post-recovery work of emergency management.
