Research On China's Environmental Police:System

Any environmental crimes may cause great damage to the environment and even affect the survival and health of the people.The emergence of environmental police in China is a kind of exploration that is accompanied by prominent environmental problems.The Environmental Police System is not stipulated in China's People's Republic of China People's Police Law and the Environmental Protection Law of the People's Republic of China.The environmental police system broke through the restrictions imposed by the environmental protection department on environmental law enforcement.The purpose of setting up an environmental police is mainly to combat environmental crimes and increase the deterrence of environmental law enforcement.The environmental police can make up for the lack of environmental law enforcement power,reduce the resistance of environmental law enforcement to the shock of environmental violations,help to obtain evidence for illegal activities,improve law enforcement efficiency,and strengthen environmental administrative law enforcement and criminal justice.Chapter 1 "Overview of the Environmental Police System".This chapter is mainly to explain the meaning,characteristics and role of environmental police,the composition of environmental police system,the necessity and feasibility of environmental police system construction,and the theoretical basis for environmental police system construction to provide support for environmental police construction.Chapter 2 "the main problems of the construction of environmental police system in China".Firstly,it analyzes the problem of the ambiguity of the environmental police,the second is the lack of a direct legal basis for the environmental police,and finally the law enforcement mechanism of the environmental police is incomplete.By analyzing the main problems existing in environmental police,it provides further suggestions for the construction of environmental police system.Chapter 3 "Foreign Environmental Police System".By introducing the environmental police systems in Germany,Russia,France,and the United States,the common characteristics of foreign environmental polices are sorted out.There are clear legal regulations,scientific establishment,strong law enforcement,and high specialization,which provides a reference for the construction of the environmental police system in China.Chapter 4 "Countermeasures for the Construction of Environmental Police System in China".Through the analysis of the first three chapters,it is believed that the leadership model of China's environmental police should adopt the leadership model of public security organs and form a highly specialized environmental police agency through ftmctional integration.At the same time,improve the law and uniformly stipulate the names and duties of environmental police.Strengthen the construction of environmental police law enforcement mechanisms,improve the channels and procedures for obtaining case clues,and focus on strengthening the connection between environmental administrative law enforcement and criminal justice.
