Research On The Legal System Of Prevent And Control Biological Invasive In China

The globalization of human activity space makes it possible for species to redistribute around the world consciously or unconsciously.Some of these exotic species grow wildly in the new environment and suppress native species,which pose a serious threat to the ecological environment,human health and economic development,and form a serious biological invasion phenomenon.China is a country that has suffered serious harm from biological invasion.It is urgent to establish and improve the legal system of biological invasion prevention and control in China.The first part of this paper explains the research background,purpose,significance and content,and analyses the important value of the construction of biological invasion prevention and control legal system.The second part is an overview of the legal system of prevention and control of biological invasion.Firstly,biological invasion means that an organism enters a new habitat system from its original habitat through a certain way,and then brings a series of hazards to the area.It has the characteristics of concealment,sudden,widespread and selectivity.Secondly,it discusses the law of biological invasion prevention and control through environmental law and biology.Finally,it describes the meaning of the system: in order to prevent the invasion of exotic organisms from harming the local ecological security and biodiversity,the general term of legal norms in which nature is the medium and the relationship between people is the object of adjustment.The third part analyses the current situation and shortcomings of the legal system of biological invasion prevention and control in our country.From the three stages of biological invasion prevention,border control and internal control,this paper analyses the relevant laws and regulations in response to biological invasion in China,focusing on the shortcomings,inadequate science of legislative concepts and defects of relevant legal systems,which make it impossible for China to form a strict prevention and control of biological invasion.The fourth part is the introduction and reference of foreign excellent legislative experience.By introducing the excellent legal systems of New Zealand,Japan,the United States and Australia in the field of biological invasion,we can provide useful reference for our country.The fifth part puts forward suggestions on the construction and improvement of China’s legal system to deal with biological invasion,including the creation of scientific legislative concepts,the improvement of alien species list system,risk assessment system,inspection and quarantine system,tracking and rapid response system,regulatory system,public participation and legal liability investigation system,in order to form a strict prevention and control of biological invasion.The last part concludes with a summary of the main contents of the paper,and looks forward to the development prospects of the legal system of biological invasion prevention and control in China.
