With the increasingly demand of the Marine aquatic product quantity andquality, More attention is paid to developing excellent resource of fisherin China’s marine aquaculture At the same time, it introduces manyforeign breeding to enrich the Chinese aquaculture product structure. Theintroduction of these new species, on the one hand, can promote the rapiddevelopment of China’s Marine aquaculture and economics. But on the otherhand, Marine aquaculture has become a main way of alien species invasion.Alien species invasion along with loss of Biological habitat and Globalclimate changing now become three major problems of affecting biologicaldiversity. Biological invasion has become China’s social environmentalproblems, the harm can be seen in China, and have caused serious problems.On the basis of analyzing characteristics of the Marine aquaculturealien species invasion, the author states the causes leading to alienspecies invasion in seawater aquaculture from three facets. It is foundthat the causes include loss of way of invasion and existing preventionmethod, which reflect insufficiency in deeper structure of Chinese legalsystem and management system., After analyzing relevant internationallegal documents and existing legislative situation in China, the authorsummarizes gaps in the legislation, confusion in the supervision, andholes in the management and puts forward the way to improve the situation.Contradiction is the power of the development of things, and the seabreeding alien species invasion features universality and particularity.The author grasps the main problems of seawater aquaculture alien speciesinvasion, analyzes the main existing problems and insufficiency in prevention and control of alien species, considers universality of alienspecies invasion, the and puts forward the methods to solve the problems.The objective of the study is not to put forward innovative theory, butto integrate the existing legal theories with practice. The author triesto bridge the gap in current research on make up for aquaculture in chinaand sheds light on the practice of alien species invasion.
